			<content:encoded><![CDATA[<p>This is actually not about the pleasures that we saw on the journey, more about the the condition that the India Railways seems to be in. The spouse and me have traveled to some extent on the Indian railways, criss-crossing the country through the railways (although we have a preference to the AC coaches, and not the sleeper coaches). We normally do the journey between Dehra Doon and Delhi frequently since there is family in both locations.<br />
We normally take the Shatabdi (and have been doing so for many years), and have started seeing the condition of the trains going down over the past few years. It would seem like the same coaches that were in use for the past many years are being used, which is fine, but it also seems that the maintenance of the coaches has come down drastically (and maybe this is how Laloo Prasad Yadav earned money on the railways, by cutting down the cleaning and maintenance). So, now when we go, there is a smell in the train, the loos are normally never as clean as they used to be, and of course water eventually ends midway during the trip.<br />
But what happened on the course of a journey just a few weeks back took the cake. We were not able to do the normal Shatabdi, and had to book the Jan Shatabdi that leaves in the afternoon. We thought that this is a train that also has non-AC coaches, but everything else would be the same (the ticket price was around the same). First surprise, the train was 1 hour late. And when the train came, passengers started coming out from the train (which means that the train had just arrived and they had decided to move the same train to departure). The reaction of people when they entered the AC chair car was incredible, one could not believe how dirty the train was. There were cups on the floor, there was coffee and tea on the floor and some of the seats, and also other rubbish (this was done by the departing passengers, but it was the responsibility of the railways to ensure that incoming passengers paying fare are entitled to clean coaches and clean loos (one look at the loos, and it was an attempt to hold things till we reached our destination)).<br />
We tried talking to the TT for getting hold of the complaint book (there were other problems, in some cases, the meal tray would not hold in place and kept on falling on the person in the seat), but the TT declined to offer any such book, and politely told us that such things happen once in a while, what is the point of raising such a complaint. This also told us the likely treatment of any complaint that we raised.</p>

			<content:encoded><![CDATA[<p>When a woman undergoes a sterilization procedure, it is with the expectation that any more sexual relationship will not result in more babies, and in today&#8217;s world where family planning is required, going in for a sterilization procedure is an act of great responsibility. When the family feels that they have had enough children, then sterilization is way of stopping any further children from coming. To make it easier for poorer families to adopt such a procedure, the various Governments provide camps where sterilization is carried out under the supervision for doctors. When a family adopts such a procedure, they do with the thought that such a camp being sponsored by the Government means a measure of reliability. So what happens when a lady finds out that she has got pregnant even after such a procedure being carried out, who bears the responsibility ? In a recent judgment, the Delhi Court has held that the State Government is responsible for the expenses for rearing the baby, especially when the household is very poor and cannot bear the expenses for rearing the baby. The expenses are to be charged from the Government, but not recovered from the doctors who carried out the operation (<a href="http://timesofindia.indiatimes.com/Delhi/Woman_compensated_for_unwanted_pregnancy/articleshow/3057909.cms" target="_blank">link to article</a>): </p>
<blockquote><p>A Delhi court has held the government responsible for the birth of an unwanted child in a poor household because the mother became pregnant despite undergoing sterilisation under a government-sponsored scheme at a hospital. Asking the government to bear the expenses of rearing the boy, additional district judge Kamini Lau awarded the 40-year-old mother, Nirmala, a compensation of Rs 1 lakh on Tuesday.<br />
While awarding the compensation, ADJ Lau said &#8220;The serious problem of population explosion warrants and demands that adequate measures be taken by the government while adopting and implementing the family planning scheme successfully.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>The Delhi Development Authority had developed a huge number of flats in the Indian capital, and settled large sections of the capital (as per its mandate). However, experiences of people vary in terms of the customer-friendly nature of the Authority. For example, the Authority has been known to delay in handing over properties, land, and is famed for the level of corruption. Raids on its officers have always managed to net people involved in corruption, and it is common knowledge that getting a file to move in the DDA headquarters is a fairly difficult task. So, it is not uncommon to hear of people, even though they have been allotted a flat by the DDA, facing huge amounts of problems in actually getting the paperwork and physical allocation. It is to solve such problems that people are increasingly taking the help of instruments such as consumer forums and courts, and these institutions are indeed helping out people <a href="http://timesofindia.indiatimes.com/Delhi/Delay-in-giving-possession-of-flat-DDA-asked-to-pay-Rs-50k/articleshow/4655108.cms" target="_blank">(link to article)</a>:</p>

NEW DELHI: The National Consumer Commission has held the DDA guilty of causing mental agony to a woman who was not handed over possession of a flat for nine years and asked it to pay Rs 50,000 as compensation. The Commission, comprising Justice R C Jain and member Anupam Dasgupta, also asked the housing agency to pay interest to allottee Prabhati at the rate of 15% on Rs 8.59 lakh for the period between 1998 to 2005.<br />
&#8220;In the facts and circumstances of the case, we hold that the delays in issuing the letter of possession of the flat and in delivering its possession are instances of gross misfeasance in the DDA,&#8221; the Commission said, adding that it was an &#8220;inexplicable and deliberate&#8221; delay by the authority. The panel passed the order on DDA&#8217;s plea challenging the Delhi Consumer Commission&#8217;s direction to it, asking the agency to pay the allottee Rs 50,000 compensation and Rs 2,500 cost.

<p>This is not the first time such a judgment has been passed on the DDA, which has been held guilty in many previous such cases of causing agony to people who have been successful in winning flats, and then being forced to wait for long periods before getting possession. And yet a systematic cleanup of the DDA does not seem like a possibility, given the vested interests involved.</p>

However, given that these Government utilities such as telecom, electricity, water, roads, post offices, etc get money from consumers (either in the form of direct payment such as electricity, post office, telecom or indirectly through the taxes we pay), it is only fair that they be held accountable when their customer service is below the desired quality levels or when their actions cause harm to consumers. And so it has started to happen, consider this case when the postman did not deliver a mail claiming that the address could not be found, that when the complainant directly was able to locate the address <a href="http://timesofindia.indiatimes.com/Mumbai/Non-delivery-of-mail-costs-postal-officials-dear/articleshow/4511412.cms" target="_blank">(link to article)</a>:</p>

The South Mumbai District Consumer Disputes Redressal Forum has directed the chief postmaster-general of Mumbai and the postmaster in charge of Tardeo post office to pay Rs 8,000 for non-delivery of mail. The consumer court had initially sent a notice to a Mahim airconditioner dealer after Shobha Alimchandani complained of deficiency in service but the envelope came back, with &#8220;address not known returned to sender&#8221; stamped on it. Alimchandani then located the address and filed a complaint against post office officials for shoddy service.<br />
&#8220;We direct postal officials to jointly pay the complainant Rs 5,000 as compensation for expenses and Rs 3,000 as compensation for harassment,&#8221; the forum said. Consumer activist Rajan Alimchandani said the complaint was filed on realising that the complainant was being fooled by the postman who had not delivered the mail deliberately.

<p>In this case, the case also included the top official of the postal department for Mumbai, thus ensuring that responsibility for shoddy performance is laid at the responsible level. </p>

Consider this case of the municipal corporation of Pimpri-Chinchwad that has launched a SMS complaint service on a trial basis and started receiving complaints on this service <a href="http://timesofindia.indiatimes.com/Pune/Now-send-an-SMS-to-file-civic-complaints-in-PCMC-areas/articleshow/4526853.cms" target="_blank">(link to article)</a>:</p>

Residents of Pimpri-Chinchwad can now register a complaint against civic problems by simply sending an SMS. The Pimpri-Chinchwad Municipal Corporation (PCMC) launched the SMS complaint service on a trial basis on March 20. Since then, around 70 grievenaces have been received, of which only seven are pending.<br />
The civic authorities will classify the compliants as either simple or complex. &#8220;Simple complaints would be those which can be solved in a few days, like potholes, choked drainages, and so on. The complex ones are those that require a longer time for redressal,&#8221; Sharma stated. The SMSes can be sent to the mobile phone number 9922501450. Citizens should include their name and address in their text message. Grievances can also be e-mailed to complaints@pcmcindia.gov.in.

<p>It is good to see that the municipal authorities are taking action that is helpful to citizens, and one hopes that other municipal corporations also adopt such practices, and that the Pimpri-Chinchwad continues down this path.</p>

The level of services varies from city to city, but some of the biggest problems that people currently face are examples of sorry state of sewage and cleanliness, poor condition of roads and streets, inadequate sanitation and garbage collection, poor upkeep of our current infra-structure. These problems can be attributed to bad governance, bad leadership, corruption and sheer laziness. Many times, citizens suffer because of this, and because of lack of responsibility, are unable to do much about this poor condition of municipal services. However, the courts are always a way to get justice, even if it <a href="http://timesofindia.indiatimes.com/Chennai/Corporation_fined_for_childs_death/articleshow/3663866.cms" target="_blank">takes a decade to do this</a>:</p>

CHENNAI: The Madras high court has directed the Chennai Corporation to pay compensation of Rs 1 lakh to the parents of a child, who drowned in a storm water drain negligently left open by sanitation workers. Pointing out that the 18-month-old Venugopal died over 10 years ago, Justice Chandru decried the Chennai Corporation for having failed to submit its reply to the court in a timely manner.<br />
He directed the civic body to pay the compensation amount to the child’s parents within four weeks, and warned that any failure in this regard would be viewed seriously by the court.  &#8220;Insofar as the death of Venugopal, the Chennai Corporation is squarely responsible. Because of their negligence in not keeping the storm water drainage in closed condition, such an incident had happened. The minor Venugopal cannot be expected to know the danger of the stormwater drainage kept in an open condition,&#8221; he said.

<p>In this case, the drain was kept open while cleaning was happening. This is negligence, since as the court pointed out, it is not expected that children will have the same sense of danger. Keeping a drain open like this was hence very dangerous.</p>

			<content:encoded><![CDATA[<p>Suppose you have never needed a PAN card till now, and now you find that you are starting to earn some money (your first job, and boy, does it feel good to start earning some money of your own). You need a bank account, you want to invest some of this money for the future, and suddenly everybody starts asking you to make a PAN card. A 1. PAN card, what&#8217;s that and why do you we need it ?<br />
What Is PAN? &#8211; Permanent Account Number (PAN) is a ten-digit alphanumeric number, issued in the form of a laminated card, by the Income Tax Department.<br />
2. Why Is It Necessary To Have PAN? &#8211; It is mandatory to quote PAN on return of income, all correspondence with any income tax authority. From 1 January 2005 it will be mandatory to quote PAN on challans for any payments due to Income Tax Department.<br />
It is also compulsory to quote PAN in all documents pertaining to financial transactions notified from time-to-time by the Central Board of Direct Taxes. Some such transactions are sale and purchase of immovable property or motor vehicle or payments in cash, of amounts exceeding Rs. 25,000/-to hotels and restaurants or in connection with travel to any foreign country. It is also mandatory to mention PAN for obtaining a telephone or cellular telephone connection. Likewise, PAN has to be mentioned for making a time deposit exceeding Rs. 50,000/- with a Bank or Post Office or depositing cash of Rs. 50,000/- or more in a Bank.</p>
<p>But, worry not, you can easily generate a PAN card for your own use. You need to apply through the relevant PAN application form, and here is an Online site that lets you do the same (<a href="https://tin.tin.nsdl.com/pan/index.html" target="_blank">link</a>). However, this is not always true, and the Government has been able to surprise us many times by showing its ability to adopt some of the newer technologies, and at the same time, do so with the required safe-guards. So, first we had the railways ticket booking website, <a href="http://irctc.co.in" target="_blank">http://irctc.co.in</a>, and then we have the Tax Authority of the country trying to use all modern trends for tax filing. So, if you refer to the <a href="http://www.incometaxindia.gov.in/" target="_blank">website (link)</a> for Income Tax India, you will be able to download forms, and read more about details related to your tax filing. The website even has a very basic Tax calculator (<a href="http://law.incometaxindia.gov.in/TaxmannDit/xtras/taxcalc.aspx" target="_blank">link</a>)<br />
The entire procedure for paying tax online is initiated at this link (<a href="http://www.incometaxindia.gov.in/ePayment.asp?abc=1" target="_blank">link</a>), with a more detailed explanation about how to find list of banks, making payment and challan details, getting receipt / confirmation, etc available at these 2 documents (<a href="http://www.incometaxindia.gov.in/archive/ePayment%20procedure.pdf" target="_blank">link 1</a>, <a href="http://www.incometaxindia.gov.in/archive/How%20to%20make%20online%20tax%20payment%20from%20home_office.pdf" target="_blank">link 2</a>). 			<content:encoded><![CDATA[<p>Citizens of the country have mostly bad thoughts about interacting with Government bodies; a lot of them come across officialdom who are not responsive and caring about their needs (as an example, making them come repeatedly even for small errors in the red tape process), and so on. There are babus (officials), who are friendly, but most are like hard faced officials, unwilling to come across as caring people. It would be nice for people to live in a gated community (and self-sufficient place) where one would not have to interact with the Government bureaucracy, but that is living in an ideal world. However, there are cases when official responses are such that you would be horrified to read about such cases, and wonder as to how the official structure of the country could be so insensitive to the problems faced by citizens, that too when the situation is due to a fault of the agency themselves. The Delhi Development Authority however has been roundly criticized from time to time over its openness, caring nature (lack of it), and inability to care about what citizens go through. Wondering if DDA derives &#8220;some kind of sadistic pleasure&#8221; in harassing citizens, Delhi High Court has slammed the civic agency in a case of double allotment of a flat in 1991 due to which the rightful owner was deprived of its possession and had to wage a 17 year legal battle in court.<br />
&#8220;Ignoring dictum of law the officials of DDA keep perpetuating their illegal acts giving an impression as if they derive some kind of sadistic pleasure to harass the citizens,&#8221; HC observed while castigating the civic body for having the nerve to demand double the price of a flat which wasn&#8217;t handed over to Gandhi in 1991 because of DDA&#8217;s double allotment mistake.

<p>This case really highlights as to how uncaring an agency can be. DDA double-allotted a flat in 1991, and when the lady in question tried to get the mistake corrected, the DDA did a fresh allotment to her after 10 years and charged her new prices, at double the original cost. In such cases, the Court should also assign individual responsibility and fine officials responsible (including fining officials of the rank of Chairman and Vice-Chairman if they had made such recommendations).</p>

			<content:encoded><![CDATA[<p>It seems to be a story that keeps on repeating itself over and over; you hear of people being harassed by loan recovery agents for repayment of loans, or of somebody&#8217;s vehicle being taken away from them anywhere where the vehicle can be found, and so on. In extreme cases, the pressure or violence of the recovery agents can lead to injury or death of the person having taken the loan. The financing company or bank having advanced the loan would take recourse to goons or musclemen and they would use or threaten force in this regard.<br />
For the last 2-3 years, this practise has been challenged in court, and there have been a number of decisions in this regard. Here&#8217;s another substantiating the same point that a loan recovery company cannot use force for loan recovery. Since a loan agreement is a civil contract, recovery of loan amount or the assets bought against the loan also can happen only when <a href="http://economictimes.indiatimes.com/Banking/Loan_recovery_Citicorp_fined_for_using_force/articleshow/3105497.cms" target="_blank">there is a court order</a>:</p>

Unless a bank or a financial institution is equipped with a court order to repossess a vehicle which it has given on loan, it has no authority to go to the residence of the borrower to take away the vehicle by force. This was observed by the state consumer commission in a recent order.<br />
Taking strong exception to the method adopted by a finance firm to recover dues in the form of a few unpaid instalments from a consumer who took the money to purchase a vehicle, the commission headed by Justice J D Kapoor directed Citicorp Finance (I) Limited to pay Rs 50,000 to one Jan Mohammad, a resident of Mehrauli, for the mental agony, harassment and public humiliation he faced. It was observed by the commission that no financier or bank had the authority to forcibly take possession of the vehicle as the loan agreement or hire purchase agreement were civil contracts and therefore had to be enforced through civil remedy. In other words, through intervention of the court.
</p></blockquote>
<p>It may be argued that the judicial system in India is slow and cases take a long time to settle; however that cannot be an argument for using force or illegal means. A company needs to act in the constraint of the law, so they need to use greater discretion when deciding loans, or they need to go in for more out-of-court settlements in such cases.</p>
